By accessing or using Monipix (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Monipix provides image and video creation, transformation, and upscaling services. The Service may be available through the Monipix website and approved connected clients, including plugins for ChatGPT and Codex. The Service includes free and paid tiers with different features and limitations.

3. User Accounts

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

4. Acceptable Use

When using our Service, you agree NOT to:

  • Upload illegal, harmful, threatening, abusive, or otherwise objectionable content
  • Upload content that infringes on intellectual property rights
  • Upload content containing viruses or malicious code
  • Attempt to gain unauthorized access to our systems
  • Use the Service for any illegal or unauthorized purpose
  • Resell or redistribute our Service without permission
  • Use unauthorized automated systems or bots to access the Service; approved Monipix integrations and plugins are permitted

5. Content and Intellectual Property

Your Content

You retain all rights to the images you upload. By uploading content, you grant us a limited, non-exclusive license to process your images solely for the purpose of providing the Service.

Our Content

The Service, including its original content, features, and functionality, is owned by Monipix and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6. Credits and Subscriptions

  • Free Plan: 10 credits per month, reset on the 1st of each month
  • Paid Plans: Credits allocated based on subscription tier
  • Unused credits do not roll over to the next month
  • Credits are non-transferable and have no cash value
  • Subscription fees are non-refundable except as required by law

7. Payment Terms

  • All payments are processed through Stripe
  • Subscription fees are billed in advance on a monthly or annual basis
  • You authorize us to charge your payment method for all fees
  • Price changes will be notified 30 days in advance

8. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial months or unused credits, except as required by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

IN NO EVENT SHALL IMAGEUPSCALER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Monipix and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Monipix operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
